Gun Laws in Florida???
 
Last year when I was hanging out in Florida I could not get gun dealers to agree on what Florida gun laws are.

I was not going to a lawyer as I only planned to be there for like two months.

This all started with a realtor taking me to a boat launch. Big sign no guns at boat launch. I was following her as she showed me how close the property was to the boat launch. Of course I'm packing big time but drove into the launch anyway.

In my travels I kept seeing these signs?

Well one time I was looking for a mans house. I could not find it. Their was a flood going on and I came to a boat launch near his house. I pulled up and parked in front of a mans home instead of the boat launch. He was in his garden and I asked questions to the road I was looking for.

Well I wanted to see how high the river was. So I walked down the boat launch. There was a man launching a small boat with a female and two young couples hanging out there.

I personally would not have gone out on the river unless I really needed to as it was still very high.

I started talking to the young people. They were super nice and respectful. I was a pit shocked as I was told this was a ruff area by the man whose house I was looking for.

I never really paid much attention to the man launching the boat but after moving his truck I saw him walk back to his female and his boat.

He was packing a big hand gun in a shoulder holster? He did not look like a cop to me?

So why was he allowed to open carry in Florida and at the boat launch?

Well the teenagers left and I went back to my van. As I was leaving to go look for my friends home all these teenagers were taking up the whole road. They let me pass and I kept looking for my friends home.

Well I just could not find his place and as I was looking for it I came again across the two teenage couples. Thinking to my self that they were very nice I pulled up next to them and asked if the knew the road I was looking for. Well the male closest to my window gave me this look and attitude that he was possessed by satan. Just evil acting. They did not know where the road was.

Well I drove on and found his house but he was not home.
Leaving, I again run into the young people. They try to flag be down but I know they appear to be evil scum that would love to rob me.

I drove past them.

Funny thing is I was way more armed that the man with just the hand gun:-)

So this experience got me asking questions.

One dealer said I could run around with loaded shotguns or rifles in my van and a different dealer said they had to be locked up but could be loaded?

So what is the truth on Florida and long guns in the car?

What's the deal with handguns and no concealed carry permit? Can you have loaded hand gun in car with no permit? What are the rules.

This computer will not open some links so I would like to hear what people believe the rules are about guns rules in Florida.

First Florida does recognize out of state CCW permits but you have to follow Florida laws. Open carry is permitted while fishing.

You can have gun racks for LONG GUNS, loaded, IN your car or truck, and have them visible in Florida. Its just not a good idea. A) because not every cop or citizen knows this, and B) cause theyll probably get stolen.

YOU MAY NOT have a loaded handgun VISIBLE in your car, but you may have a loaded handgun IN your car as long as it is "securley" encased, I.E. in a back pack, in the gun case, in your glove box, etc. If you have a CCW it may be on your body while in the car. There is no law saying you cant have a LOADED handgun in your car.

If you have a loaded handgun in your car without an FFL, you have no duty to inform (tell a cop) unless he specificaly asks you. If you have a concealed weapon on you while driving, you DO Have to tell the cop at the earliest opportunity and hand him your CCL when you hand him your Drivers License. Hes gonna know anyways, cause its attached to your license plate in the computer system.

If you are out in public with a CCW, Florida or Out of State, you do NOT have a duty to inform an officer unless you are "detained" and they ask, in which case you would again tell him, yes you have it, where it is, and present your CCL. If you meet one in casual happenstance you DONT have to tell them, and they wont really care for the most part. I helped a Deputy push a stalled car two blocks with my .45 on my hip, guy never knew it was there and I didnt have to tell him, so why even bring it up?

If you have an out of state CCL, you may only carry a handgun. If you have a florida CCL , you may carry knives, tasers, guns, etc, CONCEALED

Having a CCW in florida does NOT permit you to Open Carry. Youll get arrested for brandishing if you are off private property or do not haver permission to carry on said property. Depending on your neighborhood, ya might have some cops show up even if you ARE on private property, your own or otherwise just cause most cops and citizens dont know the laws. So be carefull and use judgment.

It is legal to have guns on boats. As far as the sign, that could be because its private property, not sure. But if its in a case and stowed while youre launching, whos gonna know?

Florida does recognize out-of-state CCWs, but only from those states that have reciprocal agreements and honor Florida CCW in their states.

I could be wrong, but these signs are probably at public boat launches. Around here, these launches fall under either county or state jurisdiction, and are therefore considered public "parks." As such, firearms are prohibited in these parks.

You probably already know this, but you also can't carry in any "government" building. Places like the county tax assessor's office, driver's license bureau, police stations, etc.

12) No license issued pursuant to this section shall authorize any person to carry a concealed weapon or firearm into any place of nuisance as defined in s. 823.05; any police, sheriff, or highway patrol station; any detention facility, prison, or jail; any courthouse; any courtroom, except that nothing in this section would preclude a judge from carrying a concealed weapon or determining who will carry a concealed weapon in his or her courtroom; any polling place; any meeting of the governing body of a county, public school district, municipality, or special district; any meeting of the Legislature or a committee thereof; any school, college, or professional athletic event not related to firearms; any school administration building; any portion of an establishment licensed to dispense alcoholic beverages for consumption on the premises, which portion of the establishment is primarily devoted to such purpose; any elementary or secondary school facility; any career center; any college or university facility unless the licensee is a registered student, employee, or faculty member of such college or university and the weapon is a stun gun or nonlethal electric weapon or device designed solely for defensive purposes and the weapon does not fire a dart or projectile; inside the passenger terminal and sterile area of any airport, provided that no person shall be prohibited from carrying any legal firearm into the terminal, which firearm is encased for shipment for purposes of checking such firearm as baggage to be lawfully transported on any aircraft; or any place where the carrying of firearms is prohibited by federal law. Any person who willfully violates any provision of this subsection commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.


THats where you CANT carry in florida with a CCW.

The sign is uninforcible by law, at most the property owner/supervisor/attendant can ask you to leave and if you come back give you a tresspass warning/violation, but you want get arrested for carrying, unless you carried open, or brandished, etc. CCW'ers may carry in florida state parks.

This is about what I was told in one gun shop. But you explained things much better.

I do not like to get permission slips so I like to stay with in the rules and still be armed.

These boat launches were along the Suwannee river and they are state owned. I was told?

No alcohol allowed also. The realtor stated it was because if they were drinking and packing things could get very unsafe:-)

I seem to have this thing for hanging out in very rural areas with big rivers?

The area I hang out in Florida is so red neck many people say its like stepping back in time. One guy stated that in the thirty years that he been cutting through and living in the place it has not changed.

I hear ya about getting them permit slips, I dont like either, but for reasons their own, each man does things.

Not sure about the consumption of alcohol while packing. You cant be at a business where alcohol is CONSUMED and equals greater than 51% of their revenue. Like a sports bar, but not say a TGI Fridays (where you just have to stay away from the bar itself) or a Liquor store (where no consumption is going on). However, consuming mind altering substances of any type while carrying a loaded weapon is probably not a good idea anyways, but again, each man must draw that distinction for themselves.

Not sure about what parks are and arent state owned, most will have it posted if Im not mistaken. (I.E. the distinction of STATE PARK SUCH AND SUCH). It is legal to carry in state parks concealed if you have a CCW from what I understand it, but obviously not open carry and I think long guns, unless its hunting season, have to be in teh trunk. Im not 100% on that though.

Better to be safe than sorry, and sometimes that means protecting yourself from dangers as well as prosecuters. But again, a distinction left to each own mans(or womans) own judgment. :wink:

I live in south florida commie, new yorker ville, (and hate it) but there are most certainly some places in florida where you could be back in the 50's, hell even some in the 20 or 30's. They are mostly in the center of the state and up north and into the panhandle. Some real pretty places up there for sure too.

Florida is 3 different states in one. The Panhandle is still old (good) Florida, central FL is the Republic of the Stripmall, and the South is third world.

I'm older, half blind, not sure about my hearing and I like a place that it more real in my eyes.

The wife plans on getting permit slip for packing and we may hang out in the new place year round for awhile? We want to get a real feel for the place not being just snow birds. Plus we are not rich and the new place will need some work. We have acres of land:-)

Most of Florida I can stand for like thee months to get out of the cold but I really like it in this rural spot.

I drove with out permit slip for like thirty years but the cops are so brainwashed and mind controlled that I got a permit slip to drive this year. I felt like I was selling out but did so anyway:-(

So I have a place in a no town, with no local cops and the county is so poor that there are not even that many sheriffs:-)

Gun shots are heard near every day just like our place up north.

That Ocala national forest is still very sweet.

I was willing to buy a place there but the wife said it was to small.

It was a hunting fishing camp, turnkey. It was stocked with everything, tree stand, even booze and beer.

It was solid and a very fair price.

No boat.

Sounds like you're up near 1-10 :)

I do like it up there. My wife and I are wanting to get a homestead in the near future after we get some things worked out. We are looking at either north florida, or tennessee. Probably will go to Tenn, cause Im over florida, but well see. Ive got a friend (whos on GIM) that has an acerage up in north florida and really loves it. The wile berry bushes are a plus too.

I'm in Dixie county. Its Florida's hunting, fishing, county and the poorest county in Florida I hear :-)

Not much beach in these parts :-) !!

I like low taxes and rural cause, I hate the rat race!! I hear there is no money to be made here but I did not come here to make bucks.

I love Tennessee my dad was born there and I spent time this spring looking over part of the state. It rained like crazy and I cut my trip a bit short.

My dad in-law really wishes he would have looked over Florida before buying a place now that he has seen the kind of places I like down here.

Dont think I've ever been to dixie county. Theres not much money to be made in florida right now regardless, but like you aid, if you arent here for that, then thats just one less thing to worry about.

Hey, hunting seasons here btw! They have a more broken up schedual (IIRC) in the north and central part of the state though. Florida deer is pretty tasty!
